CONTEST OFFICIAL RULES
NO PURCHASE NECESSARY. CONTEST ONLY OPEN TO LEGAL RESIDENTS OF THE U.S. RESIDING IN THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA THROUGH OUT THE CONTEST PERIOD WHO ARE 18 YEARS OF AGE OR OLDER AS OF FEBRUARY 15, 2010. DO NOT ENTER THIS CONTEST IF YOU ARE NOT A LEGAL U.S. RESIDENT. CONTEST BEGINS FEBRUARY 15, 2010 AND ENDS APRIL 15, 2010. VOID WHERE PROHIBITED.
1. HOW TO ENTER
No purchase, and no entry fee, payment or proof-of-purchase necessary to participate in Contest. Contest starts February 15, 2010 at 5:00 pm. CST and ends April 15, 2010 at 5:00 p.m. CST (the "Contest Period").
BY ENTERING THIS CONTEST, EXCEPT WHERE PROHIBITED BY LAW, ENTRANTS ACKNOWLEDGE THAT IF SELECTED AS A POTENTIAL WINNER, THEY WILL BE REQUIRED TO SIGN AND RETURN A RELEASE GRANTING KIMBERLY-CLARK GLOBAL SALES, LLC ("SPONSOR"), THE RIGHT TO ANNOUNCE THEIR NAME ON THE WEB SITE WWW.BEDTIMETHEATER.COM and WWW.GOODNITES.COM AND/OR OTHER PROMOTIONAL MATERIALS. THE RELEASE MUST BE SIGNED, RETURNED AND RECEIVED BY SPONSOR WITHIN FIVE (5) DAYS OF POTENTIAL WINNER'S RECEIPT OF SUCH DOCUMENT OR PRIZE WILL BE FORFEITED BY ENTRANT.
Log on to www.BedtimeTheater.com ("Web site") during the Contest Period. The first time you visit the Web site to submit an entry into the Contest, you will be required to complete an online registration form and asked to select a username and password. For subsequent entry into the Contest, you will only be required to provide your username and password then verify your personal information, submitted in prior entries, is still accurate. Online entries must be received and recorded no later than 11:59:59 PM CST on April15, 2010 to be eligible to win. Entries received by 11:59:59 PM CST every Sunday throughout the Contest Period – February 21, 28; March 7, 14, 21, 28; April 4, 11 – are eligible for that week's prize. All entries received throughout the Contest Period are eligible for the grand prize. All entries must include an original written description of Iggy's Next Adventure (title and story idea overview), in 1,500 characters or less (approximately 275 words). Sponsor reserves the right to edit or modify entries for proper trademark use, spelling and grammar. Limit one (1) entry per person and/or e-mail address, per day.
The name of the person submitting an e-mail address upon registration must be the name of the authorized account holder of such e-mail address, otherwise entry may be deemed void. In the event of dispute over the identity of a potential winner, online entries will be declared made by the authorized account holder of the e-mail address on record for the entrant, and a potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of the e-mail address tied to the potentially winning entry. It is solely the responsibility of the entrant to notify Sponsor if the entrant changes his or her e-mail address during the Contest Period. Proof of e-mailing does not constitute proof of delivery or entry. All entries become the property of Sponsor and will not be returned to entrant. Entry must not infringe the copyright, trademark, privacy, publicity or other intellectual property rights of any person or entity. Each entrant warrants that its submission is original and assigns to Sponsor all rights (including copyright) in and to the entry, so that Sponsor shall have the right to use the entry in all media, except as prohibited by law. Every online entry submission must be manually keystroked and manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or Contest service) will be disqualified and transmissions from these or related e-mail or IP addresses may be blocked.
2. PRIZES
There are three (3) types of prizes:
Eight (8) weekly prizes (one per week of the Contest) will be awarded from the eligible entries submitted during that week, each consisting of an American Express gift card in the amount of fifty dollars ($50). Actual retail value: $50. Total retail value of all weekly prizes: $400. Sponsor reserves the right to substitute a prize of equal or greater value if the weekly prize cannot be awarded as described for any reason. Limit one (1) weekly prize per name and/or e-mail address and/or household. Weekly winning entries will be deemed the "Iggy's Next Adventure of the Week" and featured prominently in the GoodNites® brand bi-monthly newsletter. Weekly prize winners are eligible for semi-finalist and grand prize.
Ten (10) semi-finalist prizes will be awarded from all entries submitted during the contest period, each consisting of one (1) MP3 player and one (1) set of speakers. Actual retail value: $250. Total retail value of all semi-finalist prizes: $2,500. Sponsor reserves the right to substitute a prize of equal or greater value if the semi-finalist prize cannot be awarded as described for any reason. Limit one (1) semi-finalist prize per name and/or email address and/or household. Semi-finalist winning entries will be deemed the "Iggy's Next Adventure Semi-Finalist Winners" and may be announced in the GoodNites® monthly newsletter. Semi-finalist winners are eligible for grand prize.
One (1) grand prize will be awarded, consisting of a check in the amount of twenty five hundred dollars ($2,500), which may be used toward a magical family vacation. Grand prize winner's winning story will also be produced and included in the next Bedtime Theater audio installment available on www.BedtimeTheater.com. Actual retail value of check which may be used towards a magical family vacation: $2,500. Sponsor reserves the right to substitute a prize of equal or greater value if the grand prize cannot be awarded as described for any reason. Winner understands story will be expanded upon to follow format of previously produced Bedtime Theater™ audio installments and grants rights to alter written story in any manner in Sponsor's sole discretion. Winner understands the story will be produced into audio installment in months following grand prize winner announcement with the use of Bedtime Theater™ audio installment talent. Grand prize winner's name and story may be prominently featured on BedtimeTheater.com as well as in the GoodNites® monthly newsletter.
3. WINNER SELECTION, NOTIFICATION AND ANNOUNCEMENT
Weekly, semi-finalist and grand prize winners will be selected based on the following entry criteria: Originality (25%), Creativity (25%), Relevance to Bedtime Theater™ Storyline (25%) and Incorporation of Universal Teaching/Learning (25%). In the event of a tie, the tied entries will be re-judged using the same criteria, and if still tied, the entry with the highest score in Relevance to Bedtime Theater™ Storyline will be chosen the winner. Entries with content judged to be unsuitable for publication on a family-directed Web site in the discretion of the judges will be disqualified. Weekly winners will be judged by an independent judging agency whose decisions are final and binding. Semi-finalist winners will be judged by a panel of nine (9) parent bloggers, contracted by Kimberly-Clark GoodNites® brand, whose decisions using the same criteria are final and binding. Grand prize winner will be judged by visitors to www.BedtimeTheater.com (must be residents of the 50 United States and D.C. as of 11:59 4/15/10 to vote).
Each weekly prize will be determined on the Monday following the Sunday deadline each week and the weekly prize winner will be announced in the GoodNites® brand bi-monthly newsletter and the winner's prize will be sent by mail to the mailing address provided on the entry form. The semi-finalist judging period will take place between 4/16/10 – 4/30/10 and the semi-finalist winners will be announced on www.BedtimeTheater.com on 5/4/10. The grand prize voting period will take place at www.BedtimeTheater.com between 12:01 a.m. CST 5/4/10 – 11:59 p.m. CST 5/14/10. The potential grand prize winner will be initially notified by phone at the phone number provided on their entry form on or about the date their entry was selected. If the potential winner is not available at the initial call, then over the next forty eight (48) hour period following the drawing, Sponsor's designee will make up to three (3) attempts to reach the potential winner via telephone at the phone numbers provided on the entry form. If the potential winner cannot be reached in person during such forty eight (48) hour period (no messages will be left on answering machines or voice mail systems) such potential winner will be disqualified and the next highest scoring entry chosen. Sponsor is not responsible for technical difficulties with telecommunications systems beyond its control. As a condition of grand prize award, except where prohibited by law, potential prize winners will initially be required to sign and return a release granting Sponsor the right to use the potential prize winner's name and entry on Sponsor's Web sites and/or in other promotional materials. The release must be signed, returned and received by Sponsor within five (5) days of potential winner's receipt of such document. If the signed release document is not received by Sponsor within the required number of days, prize will be forfeited and an alternate winner selected. Subsequently, potential prize winners will also be required to sign and have notarized an Affidavit of Eligibility/ Liability Release, which must be signed and returned within fourteen (14) days of potential winner's receipt of such documents. Failure to return an Affidavit of Eligibility/ Liability Release within the required number of days may result in prize forfeiture, and an alternate winner may be selected. Unless otherwise noted, allow ten (10) to twelve (12) weeks for delivery of prizes by mail following completion of notification process. Prizes will only be delivered to addresses within the United States.
Regardless of the announcement of any name, you are not a winner until you have signed and returned all required documents, been officially verified as a winner and otherwise have fully complied with the terms of these Official Rules. Except in TN and where otherwise prohibited by law, by entering this Contest, entrants grant Sponsor the right to print, publish, broadcast and use worldwide in any media now known or hereinafter known the winner's name, address, entry, picture or other likeness, without additional compensation, for public relations, advertising and promotional purposes as may be determined by Sponsor.
4. ELIGIBILITY
YOU MUST BE A LEGAL U.S. RESIDENT RESIDING IN THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA THROUGHOUT THE CONTEST PERIOD WHO IS 18 YEARS OF AGE OR OLDER AS OF FEBRUARY 15, 2010 TO BE ELIGIBLE. Potential winners may be required to provide proof of legal U.S. residency if requested by Sponsor to determine eligibility and as a condition of prize award. Employees of Kimberly-Clark Global Sales and its respective parent, subsidiary, affiliate and successor companies, agents, representatives, divisions, suppliers, printers, distributors and advertising, promotional and judging agencies (collectively, "Sponsor and Promotion Parties") and the immediate family and household members of each, are not eligible to participate or win.
5. GENERAL
The State of Wisconsin in the United States shall have jurisdiction over this Contest. Prizes will be awarded and/or delivered only to addresses within the United States. Unclaimed prizes will not be awarded. Except as determined by Sponsor in its sole discretion, no substitution of prize is offered, no transfer of prize to a third party is permitted, and non-cash prizes may not be redeemed for cash value (unless at the sole discretion of Sponsor). Gift cards subject to all terms and conditions of gift card program. Prize winner(s) will be solely responsible for all applicable federal, state and local taxes on prizes. Winner will receive an IRS Form 1099 for the actual value of the prize. All other expenses on the receipt and use of the prize not specifically mentioned herein are solely the responsibility of the winner. Any portion of a prize not accepted by winner will be forfeited.
6. CONDUCT
By entering this Contest, entrants agree to be bound by these Official Rules and the decisions of the judges that shall be final and binding in all respects. The Official Rules will be posted on the Web site throughout the Contest Period. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right at its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Contest or the Web site; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
7. LIMITATIONS OF LIABILITY
Sponsor and Promotion Parties assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Contest; (d) inaccessibility or unavailability of the Internet or the Web site or any combination thereof; (e) any injury or damage to participants or to any other person's computer which may be related to or resulting from any attempt to participate in the Contest or download of any materials in the Contest. If, for any reason, the Contest is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest in whole or in part.
8. WINNER RELEASES
All entrants, as a condition of entry into the Contest, agree to release Sponsor and Promotion Parties from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with accessing the Web site, submitting an entry or otherwise participating in any aspect of the Contest, the receipt, ownership, use or misuse of any prize awarded, or while preparing for, participating in or traveling to or from any prize-related activity or any typographical or other error in these Official Rules or the announcement of offering of any prize. The winner shall bear all risk of loss or damage to their prize after it has been delivered. Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any prize.
